Waitlist Disclaimer

Thank you for your interest in POSHEAR. The following terms apply to your participation in the POSHEAR waitlist ("Waitlist"). The Waitlist is operated by POSHEAR ("POSHEAR", "we", "us"), a company established in the European Union, and is offered to adult residents of the European Economic Area, the United Kingdom, the United States, and other regions where lawful.

1. The Waitlist Is Not a Purchase

Joining the Waitlist is free and creates no binding contract for the sale of goods or services between you and POSHEAR. The Waitlist is not a purchase, reservation, pre-order, layaway, deposit, or down-payment. No payment is collected and no product is allocated to you. A binding sales contract will exist only if and when you complete a purchase under the terms then in effect at commercial launch.

2. No Guarantee of Availability, Pricing, or Specifications

Joining the Waitlist does not guarantee early access, a particular launch date, invitation order, availability in your country, regulatory clearance, product specifications, compatible accessories, color or size options, or any specific price. All product information, timelines, images, and renderings are preliminary and subject to change without notice. POSHEAR may at any time pause, modify, limit, close, or discontinue the Waitlist or the POSHEAR product program, in whole or in part, without liability.

3. Reserve List — Order and Allocation

The Waitlist is a reserve list maintained for informational and outreach purposes. Position on the Waitlist does not create a legal entitlement to be served in any particular order. We may allocate early access by region, jurisdiction, regulatory status, manufacturing capacity, fairness, or anti-fraud considerations.

4. Not Medical Advice; Not a Medical Device Claim

POSHEAR is developing an over-the-counter (OTC) hearing wearable for adults with perceived mild hearing difficulty. The Waitlist and any communications you receive are for general informational purposes only and are not medical advice, diagnosis, or treatment. The POSHEAR product is not intended to diagnose, treat, cure, or prevent any disease, including hearing loss of any severity beyond what local regulations permit for OTC devices.

OTC hearing products are not appropriate for everyone. You should consult a licensed audiologist or physician if you experience any of the following: sudden change in hearing, hearing loss in only one ear, hearing loss accompanied by pain, ear drainage or fluid, episodes of dizziness or vertigo, persistent tinnitus, history of ear surgery, deformation of the ear, or visible blood, pus, or wax buildup. Children, individuals with severe or profound hearing loss, and individuals with known otologic conditions should obtain professional medical evaluation rather than relying on OTC hearing products.

5. How We Use Your Information

We use your email address and minimal technical information (such as a hashed IP and approximate country) to confirm your subscription (double opt-in), send Waitlist-related communications, prevent abuse, and comply with law. We process this information consistent with our Privacy Policy. We rely on your consent (and, where applicable, on our legitimate interest in operating the Waitlist) as the legal basis for processing.

6. Communications and Unsubscribe

By joining the Waitlist you consent to receive product-related emails from POSHEAR (e.g., verification, milestone updates, launch notifications, unsubscribe confirmations). You can unsubscribe at any time using the link in any Waitlist email, by contacting info@poshear.com, or by using our Privacy Center. We do not sell, rent, or share Waitlist email addresses for third-party marketing.

7. Eligibility and Honest Submissions

You must be 18 or older to join. You agree to submit only an email address that you own or are authorized to use, and to provide accurate information. Automated, fraudulent, or bulk submissions are prohibited; we may remove such entries without notice.

8. Forward-Looking Statements

Materials referencing future plans, timelines, features, regulatory status, performance, or availability are forward-looking and reflect POSHEAR's current expectations. They involve known and unknown risks and uncertainties, and actual results may differ materially. Nothing on the Waitlist or in related communications constitutes a binding commitment to deliver any product or feature.

9. Limitation of Liability

To the maximum extent permitted by applicable law, POSHEAR, its affiliates, and their respective directors, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, goodwill, data, or opportunity, arising out of or relating to your participation in the Waitlist or reliance on any Waitlist communication, even if advised of the possibility of such damages. Nothing in this Disclaimer excludes liability that cannot be excluded under applicable law, including statutory consumer rights and liability for death or personal injury caused by negligence, fraud, or willful misconduct. The Waitlist is provided "as is" and "as available" without warranties of any kind. See also the limitation of liability in our Terms of Service.

10. Changes

We may update this Disclaimer to reflect operational, legal, or regulatory changes. Material changes will be highlighted with a new "Last updated" date.
